Terms of Service

1. Acceptance of Terms

By accessing or using xREI ("the Service"), operated by xREI, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or in-app notification. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of Service

xREI is a real estate investment analysis platform that provides property scoring, deal pipeline management, portfolio analytics, and market intelligence tools. The Service is designed to assist real estate investors in evaluating potential investment properties.

The Service does not constitute financial, legal, tax, or investment advice. All scores, projections, and analytics are estimates based on available data and user-provided inputs. You should consult qualified professionals before making investment decisions.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account and use the Service.

4. Subscription Plans and Billing

xREI offers multiple subscription tiers including a free tier ("Scout") and paid tiers ("Analyst," "Operator," "Team"). Paid subscriptions are billed monthly or annually, as selected during checkout.

  • Payments are processed through Stripe, a PCI-compliant payment processor
  • Subscriptions automatically renew at the end of each billing period unless canceled
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • We do not provide refunds for partial billing periods

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Price changes apply at the next billing cycle following the notice period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or disassemble any aspect of the Service
  • Share, resell, or redistribute your account access or Service data without authorization
  • Use automated tools, bots, or scripts to access the Service except through our official API
  • Interfere with or disrupt the Service or servers connected to the Service
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to other users' accounts or data

6. Intellectual Property

The Service, including its algorithms, scoring models, user interface, designs, text, graphics, and documentation, is the exclusive property of xREI, Inc. and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.

7. Data and Accuracy

Property data, market analytics, and investment projections provided by the Service are sourced from third-party providers and proprietary models. While we strive for accuracy:

  • We do not guarantee the accuracy, completeness, or timeliness of any data
  • Property scores and projections are estimates and should not be relied upon as the sole basis for investment decisions
  • Market conditions can change rapidly, and historical data does not guarantee future performance
  • You are responsible for verifying all data and performing your own due diligence

8. Limitation of Liability

To the maximum extent permitted by law, xREI, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment returns, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your data prior to termination through the available export features.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
